Powers of the Board at a Review
The Board's decision whether to continue or discharge the involuntary status is based on reviewing whether the patient has a mental illness as defined in the Act and whether the criteria of the Act for involuntary status have been satisfied and continue to be satisfied. This is the same criteria considered by a psychiatrist when placing a patient on an involuntary order: section 4 and section 26. The Board is also required when making a determination to have regard primarily to the psychiatric condition of the patient and is to consider the medical and psychiatric history and social circumstances of the patient: section 137.
